NC REALTORS Assn. Executives, Presidents & Board of Directors

Buyers and sellers seeking to recover disputed earnest money deposits may now use a new form recently adopted by the North Carolina courts.  In October 2005, the NC REALTORS® were influential in the passage of legislation that enables real estate firms holding disputed earnest money deposits to pay them in to the clerk of court’s office. After the disputed deposit is paid in to the clerk’s office, the buyer or seller can file a special proceeding with the clerk within one year to recover the disputed deposit.  Real estate agents should take special note of section #9 in the instructions on the back of the form, which provides that “[n]either the Clerk nor any real estate agent who represented a party in the real estate transaction that gave rise to this dispute can give you legal advice about your case or assist you in completing this form.”

The form is now available at the clerk of court’s office or on the NC Courts website at www.nccourts.org.  Click on “Forms” at the top of the home page and type in form number AOC-SP- 261.
